Introduction

When South Sudan was proclaimed an independent state in 2011, the ‘Transitional Constitution of the Republic of South Sudan’ was adopted. This supreme law provides the right to information and it has been supplemented with a rather strong legal framework. Notably, the law has a broad scope, as it utilizes a comprehensive definition of ‘public body’ to ensure that it applies to all three branches of government and private entities that are either funded by the state or perform a governmental function. This is supplemented by an extremely compliant exceptions system that is both harm-tested and subject to a mandatory public interest override. It also has an exemplary sanctioning system and near-perfect promotional measures mandate. A key area for further improvement, however, is the law’s underdeveloped procedure for making requests. In particular, this section would benefit from more robust provisions enumerating explicit timelines.
